RIGHTS OF DATA SUBJECTS
Within scope of Article 11 of Personal Data Protection Law No. 6698 and the relevant legislation, any person has right to apply to the Company, which is in the capacity of data controller, on the following issues:
- a) To learn whether or not their personal data is processed,
- b) To request information on the procedure, if their personal data has been processed,
- c) To learn the purpose of processing of the personal data and whether or not they are used in line with their intended purpose,
- d) To obtain information about third parties to whom the personal data have been transferred domestically or abroad,
- e) To request the correction of personal data that may have been processed incompletely or inaccurately,
- f) To request the deletion or destruction of personal data within the scope of provisions set forth in Article 7 of the Law no. 6698,
- g) To request that the third parties to whom personal data is transferred are informed of the operations carried out pursuant to sub-paragraphs (d) and (e),
- h) To object to the occurrence of an outcome which is to the detriment of the data subject as a result of the analysis of the data processed, exclusively through automated systems,
- ı) To request compensation for damages in the event that damage is sustained as a result of the unlawful processing of personal data.
PROCEDURES AND PRINCIPLES ON THE DATA SUBJECT’S APPLICATION TO THE DATA CONTROLLER
Pursuant to paragraph 1. of Article 13/1 of the LPPD and under the Communiqué on the Principles and Procedures for the Application to the Data Controller, (published in the Official Gazette issue no. 30356 dated 10.3.2018); applications to be filed with the Company, as the data controller regarding such rights, should be submitted through any of the other methods determined by the Personal Data Protection Board (“Board”).
Pursuant to article 4 Application Right of the Communique on Procedures and Principles for Application to the Data Controller, the real persons whose personal data are processed have right to apply to the Data Controller. Data subjects may exercise this right provided that they file their application in Turkish.
“Data subject” which is owner of personal data, in order to exercise all his/her rights pursuant to Article 11 of the Personal Data Protection Law No. 6698 and the relevant legislation, may file application;
- In writing,
- With secure electronic signature,
- Through Registered Electronic Mail (REM) address,
- With a mobile signature,
- By sending from the email address previously notified to the data controller by the data subject and registered in the Company’s system.
The application must include the following particulars:
- Name, surname, and signature if the application is in writing,
- Turkish ID number for Turkish citizens, and nationality, passport number, or identity number, if any, for foreigners,
- Residential or business address for notification,
- Electronic mail address, phone and fax number for notification (if any), and
- Subject of the request.
The information and documents concerning the matter, if any, shall be enclosed with the application.
In written applications, the date when the document is served upon the data controller, or its representative shall be considered as the application date.
In the applications filed through other methods, the date when the application is received by the data controller shall be considered as the application date.
The application shall be concluded on a free-of-charge basis, within the shortest time possible depending on the nature of the request, but in any event within no later than thirty days. However, if the relevant transaction requires an additional cost, the fee set out in the tariff determined by the Board may be collected.
The applications should be filed by the individual himself/herself. An application may only be filed on behalf of another person through a power of attorney, provided that it contains the authority to request for information within the scope of LPPD. The Company may request the relevant verification information if it suspects of the identity of the applicant.
